1) PREAMBLE
These general terms and conditions of sale (hereinafter “the General Terms”) govern all orders (hereinafter “Order(s)”) and the provision of coaching, ThetaHealing, and shamanism services placed on the website www.manontabaczynsky.com, by email at contact@manontabaczynsky.com, or by phone at +33789468861.
Careful reading and acceptance of these general terms and conditions of sale are mandatory before any booking of services. They apply, without restriction or reservation, to all services offered by the service provider. The service provider reserves the right to modify its general terms of sale and legal notices without prior notice or delay. The user is therefore invited to consult them when accessing the website.
The following services are offered by the provider: individual personal and professional coaching, mentoring, energy healing, and energetic practices from shamanic traditions in accordance with my certification.
Access, browsing, and use of the Site are governed by the General Terms and Conditions of Use of the website.
When a User places an order, they become a Client of the Service Provider, and their contractual relationship is governed, in addition to these General Terms and Conditions of Sale, by the General Terms and Conditions of Use of the Site.
These General Terms and Conditions of Sale are concluded between:

That is to say, a natural person aged at least 18 or the legal representative of a minor, providing justification thereof, to whom a service in the field of coaching and energy healing is provided, and who has previously and unreservedly accepted these General Terms and Conditions before placing an Order. Acceptance is materialised by clicking the mandatory checkbox “I have read and accept the General Terms and Conditions of Sale online” or by a signature if the General Terms and Conditions of Sale were sent by email or presented in paper form during the first appointment. Before validation or signature, this person is not yet a Client of Manon Tabaczynsky EI.

2) REMINDER OF THE NATURE OF SERVICES,
BOOKING & PERFORMANCE OF SERVICES
The client can use the website www.manontabaczynsky.com to book one or more services via the Contact page or by calling +33789468861.
Right of Withdrawal: In accordance with Article L221-18 of the Consumer Code: The consumer has a period of fourteen days to exercise their right of withdrawal from a contract concluded remotely, following telephone solicitation or outside of business premises, without having to justify their decision or bear any costs other than those provided for in Articles L.221-23 to L.221-25. The period begins from the day the contract is concluded for service contracts. The day the contract is concluded is not included in the period. If this period ends on a Saturday, Sunday, or a public holiday, it is extended to the next working day.
The date(s) for the provision of services are jointly agreed upon between the Provider and the Client (date, time, and place) when the appointment is made.
Coaching and energy practices can be carried out remotely via electronic communication such as video conferencing, chat, or by phone, provided the Client has internet access and/or a phone line.
A free call is made prior to each service to ensure the Provider understands the Client’s needs. This enables the Provider to deliver the best possible service to the Client.
DISCLAIMER:
It is generally, and specifically in cases of behavioural disorders or illnesses requiring psychological or psychotherapeutic support, the Client’s responsibility to inform Madame Manon Tabaczynsky.
By consenting to these general terms and conditions of sale, the Client acknowledges having been fully informed of any potential risks by Madame Manon Tabaczynsky.
Additionally, the Client consents to having been informed that the services offered are complementary to any possible medical and/or psychotherapeutic support. It is the Client’s responsibility to consult their healthcare professional before stopping or altering any complementary medical treatment.
Lastly, Madame Manon Tabaczynsky reserves the right to terminate the support, in accordance with these General Terms and Conditions of Sale, when she identifies the need for the client to seek guidance from a healthcare professional.
3) PRICES AND PAYMENT TERMS
The prices listed on the website are expressed in Euros, inclusive of all taxes (TTC), and correspond to those in effect on the day of the order. The prices for orders are set by the Provider. These prices may vary depending on the type and duration of the services provided.
The Provider reserves the right to modify its prices at any time, but orders will be billed based on the rates in effect at the time of the order’s confirmation.
Payment is made by bank transfer no later than 48 hours before the day of the service or can be processed directly online via the booking tool Calendly, using the Stripe payment system (credit card payment). Failing this, Manon Tabaczynsky reserves the right to cancel the service.
The Client is informed that the services are not reimbursed by social security.
The Provider also reserves the right to offer preferential rates and promotional offers. The terms and duration of these advantages will be presented on the Website and/or communicated to Clients and Users of the Website by any other means.
4) RESCHEDULING, CANCELLATION, AND MODIFICATION OF AN APPOINTMENT
If the Client does not attend the appointment, the session will still be owed by the Client.
An appointment can be cancelled or rescheduled at no extra cost, at least 24 hours in advance, once, by contacting Mme Manon Tabaczynsky by phone at +33789468861. For bookings made online via the contact page of the website www.manontabaczynsky.com and through the Calendly tool, the Client can cancel and reschedule their appointment directly online at no additional cost. The Calendly tool does not allow for automatic refunds. In case of online cancellation, the refund must be handled on a case-by-case basis with the Provider.
The Provider reserves the right to refuse further consultations with a client who has previously defaulted on a payment or has already requested a refund for a previous consultation.
Manon Tabaczynsky EI also reserves the right to refuse a consultation if it is deemed that the reason for the consultation is outside the Provider’s area of expertise or if the Client’s behaviour is inappropriate for the proper conduct of the consultation (courtesy, politeness, respect, and refraining from making inappropriate propositions under penalty of legal action). Any amounts paid will be fully refunded.
5) DISPUTE RESOLUTION
These General Terms and Conditions of Sale and the operations arising from them are subject to French law. For any complaints, please contact the Provider by email.
These General Terms and Conditions of Sale are written in French. If they are translated into one or more foreign languages, only the French text shall prevail in case of a dispute.
The parties agree to attempt to resolve any dispute between them amicably. The Client is informed that they may resort to conventional mediation through existing sectoral mediation bodies or any alternative dispute resolution methods in case of a dispute.
The designated mediator is: CNPM.

After the Client’s prior written approach to the Provider has remained unsuccessful, the mediator’s service can be contacted for any consumer dispute that has not been resolved.
In the event of a dispute with a Client that cannot be settled amicably, express jurisdiction is granted to the court of the defendant’s place of residence, in accordance with Article 42 of the Code of Civil Procedure, or, at the defendant’s choice, the place of actual delivery of the Product sold, in accordance with Article 46 of the Code of Civil Procedure.
Since 15 February 2016, the European Commission’s online dispute resolution platform has been open to the public. Any consumer who encounters a dispute with a business located within the European Union can file a mediation request through this European platform. The Client can also visit the European Commission’s website dedicated to consumer mediation: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=EN.
6) PERSONAL DATA PROTECTION
In accordance with Law No. 78-17 of 6 January 1978 relating to data processing, files, and freedoms, you have the right to access, modify, rectify, and delete data concerning you, which you can exercise via the contact form.
The information you provide when booking a consultation will be used only for the execution of the booking by Manon Tabaczynsky EI (appointment scheduling, invoicing, emails, etc.). Your data will never be transmitted to third parties or sold to anyone and is kept confidential for 12 months from the date of your registration. The information collected (name, first name, email, IP address, etc.) is recorded in a computerized file by the provider.
7) INTELLECTUAL PROPERTY AND COPYRIGHT
All texts, photos, infographics, videos, audio, pages, and the logo on this site are the exclusive property of Manon Tabaczynsky EI and are not in the public domain.
